TERMS OF SERVICE
ARE FILM — Swiss Media Production
Effective Date: 19 October 2026
Last Updated: 19 October 2026
Version: 1.0
01 — General Provisions
These Terms of Service govern the use of the ARE FILM website and, where expressly incorporated into a contractual agreement, the provision of film production, photography, and related creative services.
ARE FILM is operated by Andri Reiser as a sole proprietorship registered and operating in Switzerland.
Our work includes documentary filmmaking, commercial productions, brand films, photography, and visual storytelling.
Individual quotations, production agreements, and written arrangements take precedence over these general terms in the event of conflicting provisions.

03 — Services and Scope of Work
ARE FILM provides professional film production and creative services, including concept development, pre-production, cinematography, photography, production management, editing, colour grading, sound post-production, animation, and visual effects.
The scope of each project is defined in the corresponding quotation or production agreement.
Services, deliverables, formats, production dates, and fees are agreed individually.
Any work exceeding the agreed scope requires additional agreement and may result in additional charges.
ARE FILM may engage qualified freelance professionals and production partners where necessary.
04 — Quotations and Agreements
Project enquiries and initial consultations do not automatically create a contractual obligation.
Quotations describe the proposed services, deliverables, estimated production schedule, and applicable fees.
A binding agreement is established when both parties agree to the essential contractual terms.
Unless otherwise specified, additional services, changes to the production scope, or substantial modifications to an approved concept are subject to separate agreement.
05 — Production and Collaboration
ARE FILM undertakes to perform agreed services with professional care and diligence.
Production schedules are coordinated with the client and relevant production partners.
Clients are responsible for providing necessary information, materials, approvals, and access to agreed locations within reasonable timeframes.
Delays caused by missing information, changes in requirements, or circumstances outside ARE FILM’s reasonable control may affect the production schedule.
Any resulting adjustments will be communicated to the client.
06 — Fees and Payment
Production fees are determined individually and specified in the relevant quotation or agreement.
Unless otherwise agreed, invoices are payable within 10 calendar days of issuance.
For ongoing collaborations, services may be invoiced monthly based on the work completed during the respective billing period.
ARE FILM may request advance payments or production deposits where appropriate and agreed.
Additional services and approved third-party expenses are invoiced separately unless expressly included in the agreed project fee.
All prices are stated in Swiss francs (CHF), unless otherwise specified. Any applicable VAT will be indicated in the relevant quotation or invoice.
07 — Expenses and Additional Costs
Expenses incurred in connection with a production may be charged separately where agreed with the client.
These may include travel, accommodation, meals, location fees, equipment rentals, permits, and other production-related expenses.
Unless otherwise agreed, travel by private vehicle may be charged at CHF 0.70 per kilometre.
Meal expenses and other production costs are calculated according to the relevant project agreement.
Additional expenses requiring client approval will be communicated in advance whenever reasonably possible.
08 — Feedback, Revisions and Approval
Clients are expected to review delivered materials within the agreed review period.
Unless otherwise specified in the production agreement, one consolidated revision round is included in the agreed production fee.
Additional revisions, substantial creative changes, or modifications outside the original scope may be charged separately.
Where expressly agreed, clients shall review submitted deliverables within five working days and communicate any objections in writing.
A contractual acceptance procedure does not exclude mandatory statutory rights relating to defects or non-performance.
09 — Changes, Postponements and Cancellations
Changes to confirmed production dates or project requirements may affect the agreed schedule and costs.
Where a project is postponed or cancelled, ARE FILM may charge for work already performed and recover contractually agreed or legally recoverable expenses and commitments.
Any specific cancellation fees, notice periods, or non-refundable deposits must be defined in the relevant production agreement.
Ongoing production arrangements may include separately agreed termination periods.
10 — Intellectual Property and Copyright
Unless otherwise agreed in writing, copyright and other intellectual property rights remain with their respective legal rights holders.
The commissioning or payment of a production does not automatically transfer all underlying intellectual property rights.
Creative concepts, scripts, original footage, photographs, editing projects, and other production materials may be protected under applicable copyright law.
The scope of rights granted to the client is determined by the relevant production agreement.
Third-party materials remain subject to their respective licensing conditions.
11 — Usage Rights
Upon full payment of the agreed fees, the client receives the usage rights specified in the relevant production agreement.
These rights may include commercial use, online publication, advertising, social media distribution, internal communication, or other agreed applications.
The duration, territory, exclusivity, and permitted forms of use are determined individually.
Where expressly agreed, ARE FILM may grant exclusive, worldwide, and unlimited usage rights to the final deliverables.
Such rights do not automatically include raw footage, editable project files, or third-party materials beyond their applicable licences.
12 — Raw Footage and Production Files
Unless expressly agreed, raw footage, original camera files, editing timelines, project files, and other working materials are not included in the final delivery.
The transfer or licensing of these materials may be subject to separate fees and conditions.
ARE FILM may retain production files for reasonable operational, contractual, or archival purposes.
Indefinite storage or future availability of project files is not guaranteed unless separately agreed.
Clients are responsible for maintaining backups of delivered final materials.
13 — Third-Party Rights and Licences
Productions may incorporate licensed music, stock footage, graphics, fonts, or other third-party materials.
These materials remain subject to the applicable rights and licence conditions.
ARE FILM will arrange the necessary licences within the agreed production scope.
Additional uses, distribution channels, territories, or extended licence periods may require further permissions or fees.
Clients are responsible for ensuring that materials they supply may lawfully be used for the agreed purposes.
14 — Portfolio and References
ARE FILM may request permission to showcase completed productions as references on its website, social media channels, in presentations, or in professional competitions.
The scope of such use is determined by the applicable project agreement and relevant rights.
Confidential productions, unreleased campaigns, and materials subject to publication restrictions will be handled in accordance with the agreed confidentiality and approval requirements.
15 — Confidentiality
ARE FILM treats confidential client information, unpublished production materials, business documents, and other sensitive information with appropriate care.
Confidential information will not be intentionally disclosed to unauthorised third parties.
Information may be shared with production partners and service providers where reasonably necessary for the agreed services and subject to appropriate confidentiality arrangements.
Additional confidentiality obligations may be established through individual agreements.
16 — Documentary Productions
Documentary filmmaking may involve independent research, interviews, personal experiences, and subjects of public interest.
Editorial responsibilities, creative decision-making, distribution rights, and approval procedures are defined individually where relevant.
ARE FILM approaches documentary subjects with respect for personal rights, privacy, and applicable legal requirements.
Participation in a documentary does not automatically grant editorial control over the final production.
17 — Liability
ARE FILM performs its services with reasonable professional care.
Liability is governed by the relevant production agreement and applicable Swiss law.
ARE FILM is not responsible for damage resulting solely from unauthorised, improper, or contractually prohibited use of delivered materials by the client, to the extent permitted by law.
Nothing in these terms excludes liability where such exclusion is prohibited by mandatory law.
In particular, liability for intentional misconduct or gross negligence is not excluded.
18 — Force Majeure
Events beyond the reasonable control of the parties may affect production schedules or contractual performance.
Such circumstances may include severe weather, natural disasters, government restrictions, major transport disruptions, or other extraordinary events.
The affected party shall inform the other party within a reasonable period.
Both parties will seek an appropriate solution in accordance with the applicable agreement and Swiss law.
19 — Website Use and Copyright
All films, photographs, texts, graphics, designs, and other creative materials published on this website are protected by applicable intellectual property laws.
Unless otherwise indicated, the relevant rights belong to ARE FILM or the respective rights holders.
Unauthorised reproduction, redistribution, modification, or commercial use is prohibited without the necessary permission.
Accessing this website does not grant any licence to commercially exploit its content.
20 — External Links
This website may contain links to third-party websites and platforms.
ARE FILM does not control independently operated external websites and is not responsible for their content, availability, or privacy practices.
Visitors access external websites at their own discretion.
21 — Data Protection
Personal information is processed in accordance with applicable Swiss data protection legislation.
Further information is available in our Privacy Policy.
22 — Governing Law and Jurisdiction
These Terms of Service are governed by Swiss law.
For disputes arising from commercial production agreements, the parties may agree on a competent place of jurisdiction, subject to mandatory statutory provisions.
Where no valid jurisdiction agreement exists, the competent courts are determined by applicable Swiss law.
23 — Amendments
ARE FILM may update these Terms of Service to reflect changes in its services, business operations, or applicable legislation.
The latest version will be published on this website.
Amendments do not automatically modify existing production agreements.
