01 — Introduction

This Digital Product License Agreement governs the purchase, download, installation, and use of digital products offered by ARE FILM.

ARE FILM is a Swiss film production company operated by Andri Reiser.

Our digital products may include colour grading LUTs, presets, creative assets, templates, and other downloadable resources.

By purchasing, downloading, or using a digital product from ARE FILM, you agree to the terms of the applicable licence, provided these terms have been made available to you before purchase.

This agreement applies only to digital products expressly offered under this licence. It does not govern commissioned film productions or photography services.

03 — Licence Grant

When you purchase a digital product from ARE FILM, you receive a limited, non-exclusive, non-transferable licence to use that product in accordance with these terms.

Unless otherwise specified in the product description, the licence permits use in personal and commercial creative projects.

The licence does not transfer copyright or ownership of the digital product itself.

All rights not expressly granted remain with ARE FILM or the respective rights holders.

04 — Permitted Use

Subject to the applicable licence, you may:

  • Install and use purchased LUTs, presets, and other digital assets in compatible software.

  • Apply LUTs and presets to personal and commercial film productions.

  • Use the resulting colour grades and visual effects in client projects, advertising, documentaries, social media content, and other audiovisual productions.

  • Publish, distribute, and monetise finished creative works incorporating the results of the licensed products.

  • Modify settings or combine licensed products with other creative tools as part of your workflow.

  • Create reasonable backup copies for your own use.

Finished films, photographs, and other creative works produced using our LUTs or presets remain yours or your client’s, subject to any other applicable rights.

ARE FILM does not claim ownership of your finished projects merely because you used one of our digital products.

05 — Prohibited Use

Unless expressly authorised in writing, you may not:

  • Resell, redistribute, sublicense, or share the original digital product.

  • Upload the product files to public download platforms or file-sharing services.

  • Include the original product files in another product, bundle, template, or asset collection intended for distribution.

  • Claim authorship or ownership of the original product.

  • Offer the product for free or commercially under another name.

  • Remove or alter copyright notices or licence information where included.

  • Use the product in a manner that infringes applicable laws or third-party rights.

You may not distribute modified versions of our LUTs or presets as standalone digital products without written permission.

These restrictions apply to the underlying digital product files, not to finished creative works lawfully produced using them.

06 — Individual and Team Licences

Unless otherwise stated in the product description, each purchase grants a licence to one individual user.

The licensed user may install the product on devices they personally use, provided the product is not shared with other users.

Agencies, production companies, or teams requiring access for multiple individuals may need additional licences.

Where available, team or commercial licences will be described separately.

07 — Software Compatibility

Digital products may require compatible third-party software.

For example, LUTs may be designed for use in professional editing or colour grading applications.

Compatibility requirements, supported formats, and any relevant technical limitations will be specified in the product description where applicable.

ARE FILM does not guarantee compatibility with every software version, camera system, colour workflow, or operating system.

Customers are responsible for reviewing the stated compatibility requirements before purchasing.

08 — Digital Delivery

Digital products are generally delivered electronically through a download link, customer account, or another designated delivery method.

Delivery details will be communicated during or after purchase.

Customers are responsible for providing accurate contact information and maintaining access to the files they download.

Unless otherwise specified, the purchase does not include physical products.

09 — Updates and Support

ARE FILM may provide updates, corrections, or improvements to digital products.

Unless expressly stated in the product description, a purchase does not guarantee lifetime updates, future versions, or ongoing technical support.

We may provide reasonable assistance with download problems or defective files.

Support requests can be sent to contact@arefilm.ch.

10 — Pricing and Payment

Prices for digital products are displayed at the time of purchase.

Unless otherwise specified, prices are stated in Swiss francs (CHF).

Applicable taxes and any additional charges will be disclosed in accordance with applicable law.

The licence becomes effective once the purchase has been completed and the product has been made available, unless otherwise agreed.

11 — Refunds and Digital Purchases

Digital products are delivered electronically and may become immediately accessible after purchase.

Refunds and cancellations are governed by the applicable Refund & Cancellation Policy and mandatory consumer protection laws.

Any limitations on refunds for downloaded or accessed digital products must be clearly communicated before purchase and may not override mandatory statutory rights.

Where a product is defective, materially different from its description, or cannot be delivered as agreed, customers may have rights under applicable law.

12 — Intellectual Property

All original digital products, including LUTs, presets, templates, accompanying documentation, and related creative assets, remain protected by applicable intellectual property laws.

Copyright and other rights remain with ARE FILM or the respective rights holders.

Purchasing a digital product grants a licence to use it but does not transfer ownership of its intellectual property.

Unauthorised copying, redistribution, or commercial exploitation of the original product files is prohibited.

13 — Third-Party Materials

Some digital products may contain or depend on third-party components, software, or other protected materials.

Where applicable, such components remain subject to their respective licences.

Customers are responsible for complying with any relevant third-party software terms.

ARE FILM does not grant rights to third-party intellectual property beyond those it is authorised to provide.

14 — Licence Termination

The licence remains valid unless terminated in accordance with these terms.

If a customer materially breaches the licence conditions, ARE FILM may terminate the licence to the extent permitted by applicable law.

Where appropriate, the customer will be given an opportunity to remedy the breach.

Following valid termination, the customer must cease unauthorised use and distribution of the licensed product files.

Termination does not automatically invalidate finished creative works that were lawfully produced and distributed before termination.

15 — Disclaimer and Liability

Digital products are creative tools, and their results may vary depending on source footage, camera settings, colour management, software, and individual workflows.

ARE FILM does not guarantee that a LUT or preset will produce identical results across all footage or technical environments.

We aim to describe our products accurately and provide files suitable for their stated purpose.

Liability is governed by applicable Swiss law.

Nothing in this agreement excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

16 — Governing Law

This agreement is governed by Swiss law.

Any disputes arising from the purchase or use of digital products are subject to the competent courts determined under applicable law.

Mandatory consumer protection provisions and applicable jurisdiction rules remain unaffected.

17 — Changes to This Agreement

ARE FILM may update this Digital Product License Agreement to reflect changes in its products, licensing practices, or applicable legal requirements.

The version applicable to a purchase is generally the version validly agreed at the time of that purchase, unless the parties agree otherwise or applicable law provides otherwise.
